SALT LAKE CITY — Taking the stand for the first time since she was snatched from her girlhood bedroom seven years ago, Elizabeth Smart testified Thursday that her captor raped her three or four times a day, kept her tied up with a cable around her leg, and threatened to kill her if she tried to escape.

Asked by a prosecutor to describe Brian David Mitchell, the self-described prophet accused of holding her captive for nine months, Smart replied: “Evil, wicked, manipulative, stinky, slimy, greedy, selfish, not spiritual, not religious, not close to God.”

Smart, now a 21-year-old college student, gave her horrifying account in federal court as part of a proceeding over whether Mitchell is mentally competent to stand trial.

The 55-year-old, one-time street preacher has been behind bars since 2003 — mostly in a state mental hospital — but has yet to stand trial. Twice he has been ruled mentally incompetent in state court, and he has often demonstrated bizarre behavior, including incessantly singing hymns in the courtroom and once yelling at a judge to repent.

Smart testified that within hours of her 2002 kidnapping at knifepoint, she was led away to a secluded mountain campsite and in a quickie ceremony became the polygamous “wife” of the older man.

“After that he proceeded to rape me,” Smart said, sharing for the first time publicly her account of the ordeal.

She said Mitchell showed her pornography and plied her with alcohol and drugs to lower her resistance to his sexual advances. Once, Smart said, she tried to fight Mitchell off by biting him.

On the stand for nearly two hours, Smart was poised, her voice never wavering. She did not come face-to-face with her alleged tormenter. Mitchell was removed from the courtroom for disruptive behavior — singing hymns — before Smart arrived, and watched the proceedings from a holding cell.

A federal judge ruled earlier this week that Smart’s testimony is relevant to the question of Mitchell’s competency. Mitchell’s competency hearing is not set to begin until Nov. 30, but Smart testified early because she is going on a religious mission for the Mormon church in Paris.

Smart’s parents and other family members were in the courtroom to support her. Her father Ed Smart had already heard much of the story but said later outside court he had learned a few new details. He did not elaborate.

“She actually wanted to face him,” Ed Smart said. “She asked if he could be muzzled and sit and watch.”

He praised his daughter’s composure.

“I was absolutely amazed at her strength,” he said, his eyes teary. “I don’t know how she could have done a better job than she did.”

Smart was 14 when she was abducted from her bedroom in the middle of the night. In a surprising turn that transfixed the country, she was rescued in March 2003 after a motorist spotted her walking the streets of a Salt Lake City suburb with Mitchell and his wife, Wanda Eileen Barzee.

Smart testified that in the days immediately following the kidnapping, Mitchell held her captive with the help of a 10-foot cable bolted to her leg and tethered to a line stretched between two trees. She said Mitchell threatened to kill her if she yelled or tried to get away.

Smart said Mitchell would rape her three to four times a day. There was some respite — usually when Barzee became upset over Mitchell’s relationship with Smart — but it never lasted, Smart said.

Mitchell is charged in state court with kidnapping and sexual assault. Last year, he was indicted on federal charges of kidnapping and transporting a minor across state lines. In both the state and federal cases, experts have split over Mitchell’s competency.

Mitchell’s lawyers maintain he is incompetent and suggested that evidence of his delusions can be found in his religious rambling and writings, including a 27-page manifesto he called “The Book of Emmanuel David Isaiah.”

Smart said he read from the book repeatedly during her captivity, often sang hymns and laced his conversations with religious language. Throughout her captivity, Smart was forced to wear a white, ankle-length robe, a head scarf and two veils across her face.

“He told me he was a prophet,” Smart said under cross-examination by Mitchell’s lawyer. “He said he was the voice of God on Earth and that he would reign over God’s children until Jesus came.”

But she also said his religious revelations seemed to come only when he wanted something, or when he was trying to calm Barzee. Smart said she believed Mitchell always knew that he could be punished for her kidnapping and understood how the court system worked.

She said he gave her an alias — Augustine Marshall — and told her what to say to police if they were ever questioned. He also bragged about skirting previous accusations of sexual abuse and fooling others, Smart said.

Never in nine months did Mitchell appear confused or out of control, Smart testified: “He was a very capable, intelligent human being.”

A standup routine by black comedian Eddie Griffin in South Florida was stopped after he repeatedly used the N-word, a magazine’s spokesman said Wednesday.

Griffin, who has appeared in movies such as Undercover Brother and Date Movie and the TV show Malcolm & Eddie, was performing at Black Enterprise magazine’s Golf and Tennis Challenge at Doral on Friday when he was cut off after using profanities and the N-word, said Andrew Wadium, a spokesman for the publication. ‘’We believe that ending the performance was the appropriate action,’’ Wadium said.

Griffin’s publicist, Jeff Abraham, didn’t immediately return an e-mail and a call seeking comment.

The Rev. Al Sharpton, who attended a meeting held by the magazine in Miami but not the performance, said the crowd gave an ovation to Earl Graves, the publisher, when he came on stage after Griffin was pulled, according to a statement on the website of Sharpton’s National Action Network.

Jude Law has been arrested on suspicion of attacking a photographer outside his London home, his lawyer and police said on Wednesday.

Law, 34, back from the Venice Film Festival showing of his new film “Sleuth,” went voluntarily to Marylebone Police Station in central London after the incident on Tuesday and was released on police bail.

“Mr. Law provided the police with a statement regarding his denials of allegations by a ‘paparazzi’ photographer against him and made his own allegations concerning the photographer,” said Law’s solicitor Graham Shear.

“Jude has the utmost respect for the police and whilst this is an ongoing matter no further comment will be made.”

London’s Scotland Yard police headquarters said a 34-year-old man was arrested on suspicion of actual bodily harm.

“The arrest followed an allegation of assault outside a residential address,” a police spokesman said. “The man has been released on bail … pending further inquiries.”

Johanna Cardona’s sex video was taken on cellular phone by her ex-boyfriend, Oscar Crespo. He threatened to release it after she dumped him, and somehow it make its way to the internet which he now claims is an accident. He said that he sold the iPhone with the video mistakenly on it. Fat chance.

Pro wrestler Chris Benoit, his wife and 7-year-old son were found slain Monday at their Fayetteville home, authorities said.


Detective Bo Turner told television station WAGA that the case was being investigated as a murder-suicide, but said that could not be confirmed until the evidence was examined by a crime lab.

WAGA reported that investigators believe Benoit killed his wife and son over the weekend, and then himself sometime Monday.

A concerned neighbor called police. The bodies were found in three different rooms.

The lead investigator, Sheriff’s Lt. Tommy Pope, told The Associated Press that the deaths were being investigated as homicide, and said the cause of death awaited autopsy results on Tuesday.

Pope said the three were found about 2:30 p.m., but he would release no other details about the deaths at the house in a subdivision near White Water Country Club.

World Wrestling Entertainment said on its Web site that Benoit, 40, his wife, Nancy, and son, who was named Daniel, were found dead, but also had no other details.

Benoit, a native of Canada, was a former world heavyweight champion, Intercontinental champion and held several tag-team titles over his career.

“WWE extends its sincerest thoughts and prayers to the Benoit family’s relatives and loved ones in this time of tragedy,” the federation said in a statement on its Web site.

Benoit was scheduled to perform at the “Vengeance” pay-per-view event Sunday night in Houston, but was replaced at the last minute because of what announcer Jim Ross called “personal reasons.”

Benoit maintained a home in metro Atlanta from the time he wrestled for the defunct World Championship Wrestling.

The WWE canceled its live “Monday Night RAW” card in Corpus Christi, Texas, and USA Network aired a three-hour tribute to Benoit in place of the scheduled wrestling telecast.

Benoit’s wife managed several wrestlers and went by the stage name, “Woman,” The Atlanta Journal-Constitution reported on its Web site.

They met when her then-husband drew up a script that had them involved in a relationship as part of an ongoing storyline on World Championship Wrestling, the newspaper said.

Benoit has two other children from a prior relationship.

The federal-style house is in a secluded neighborhood set back about 60 yards off a gravel road, surrounded by stacked stone wall and double-iron gate.

Monday night, the house was dark except for a few outside lights. There was a police car in front, and two uniformed officers.

Stories have surfaced that Chris Benoit killed his wife, Nancy and 7-year old son before taking his own life. What prompted Christ Benoit to take such a drastic action? Paris Hilton says in an interview from jail she’s a changed woman who now appreciates “things I took for granted” and plans to use her fame “in a good way.”


“I’m so much more grateful for everything that I have, even just to have a pillow at night or food,” Hilton told E! News’s Ryan Seacrest in a phone conversation from Century Regional Correctional Facility.

Hilton, who is scheduled to be released next week, says she plans to use her celebrity for good – and doesn’t want to be the object of ridicule anymore.

“You know my gratitude has gone up so much and I just realize that the media used me to make fun of and be mean about it,” she tells Seacrest in the interview for Thursday’s show. “Frankly [I’m] sick of it and I want to use my fame in a good way.”

Of her life behind bars, Hilton, who was jailed for violating probation for driving with a suspended license, says it’s been difficult being kept from her family. “I am behind glass and I want to give my dad a big hug and they won’t even let me do that.”

It’d be more believable if she had just let her actions do the talking. I’m sick of her giving interviews from her prison cell. It’s so lame. She should get a grip and just finish her sentence.

And while the paparazzi-pursued bombshell’s return jaunt to the slammer earned both cheers and jeers from a public weary from Paris-overload, analysts said her reincarceration after one day of freedom cast a spotlight on the drive for equal penalties for the rich and famous.

“Here, primarily because of who Paris Hilton is, the judge wanted to send a very strong message,” said Jean Rosenbluth, professor of law at University of Southern California.

“If the very same action were taken for someone who wasn’t a celebrity it would have been very rare for a judge to go back and hold this hearing and order her to prison again,” she said.

Hilton was released from jail Thursday on the local sheriff’s order after serving five days of a 45-day sentence, which she earned by violating probation after a drunk driving arrest and driving with a suspended license.

She probably thought doing a couple of days would be enough to silent everyone. She probably went in just for fun, thinking it’s only for a couple of days. She probably thought she could buy her way out. She probably thought she could get away from going to prison. She was wrong.

It’s not a game, Miss Hilton. She’s violated the laws and she shall pay for it.

Paris Hilton was released from a Los Angeles County jail early Thursday because of an unspecified medical problem and will fulfill the remainder of her sentence for probation violation in home confinement, a sheriff’s spokesman said.


The 26-year-old hotel heiress was sent home shortly after 2 a.m. wearing an electronic monitoring ankle bracelet, sheriff’s spokesman Steve Whitmore said.

Hilton was sentenced to 45 days for violating her probation in a reckless driving case, but had been expected to serve 23 days in jail because of state rules allowing shorter sentences for good behavior.

She ended up spending three full days at the all-women’s facility in Lynwood, but because she checked in late Sunday and left early Thursday, authorities credited her with five days of time served. She’ll be confined to her Hollywood Hills home for 40 days.

Hey, I’ve expected this, just not this soon. This is terribly unfair and they can’t even think up a good enough medical condition? Perhaps her genital herpes have flared up all of a sudden and orange cotton/polyester ain’t helping much to alleviate the itch.

Paris Hilton got her second visitor in jail: her psychiatrist.


Dr. Charles Sophy, the Beverly Hills therapist who has been treating her for the past eight months, entered the jail with Hilton’s lawyer Tuesday and stayed for about two hours.

Both left without commenting.

Last month, Sophy had told a judge that Hilton was so upset by her jail sentence that she was “not capable of any meaningful participation” in a $10 million slander and libel lawsuit against her.

“She is emotionally distraught and traumatized as a consequence of the findings at the May 4 hearing, the jail sentence imposed upon her by the judge, and her fear of incarceration,” Sophy wrote in papers filed by Hilton’s lawyers.

Guess it’s no surprise that one of Paris Hilton’s first visitors would be a shrink. How could poor princess Paris Hilton endure such tormenting experience? Born with a silver spoon but suddenly thrown into prison must have fooked up her mind big time. Get well soon, Paris!
